Terms and Conditions of Website Use

1. ACCEPTANCE

This document (hereinafter, the “Agreement”) sets forth the terms and conditions of Cloud Cemeteries (“CC”) info@cloudcemeteries.com, which shall apply to the access and use by the User of this website (the “Website”).

By accessing, consulting, or using the Website, Users (“You,” “you,” “User,” or “user”) agree to comply with the terms and conditions established in this Agreement. If you do not agree to be bound by these terms and conditions, you may not access or use the Website.

Cloud Cemeteries, AISA, and its affiliated companies reserve the right to update this Agreement whenever deemed appropriate. Therefore, we recommend that Users periodically review any modifications made to the Agreement.

This Agreement is governed by the applicable laws of the Republic of Argentina. Any user who wishes to access the Website from another country and use it does so at their own risk and responsibility and must ensure that such access and/or use complies with the applicable laws of their country.

2. USER REQUIREMENTS

The Website and related services are offered to Users who have the legal capacity to enter into legally binding contracts under applicable law.

Minors are not authorized to use the Website. If you are a minor, please do not use this Website.

3. LICENSE

All material displayed or offered on the Website, including but not limited to graphic material, documents, texts, images, sound, video, audio, illustrations, software, and HTML code (collectively, the “Content”), is the exclusive property of CC or the companies providing such material and/or offering services through the Website.

The Website is protected by copyright and intellectual property laws. Unless otherwise expressly provided in this Agreement or permitted by mandatory laws overriding the currently applicable laws, the User may not: (i) use, copy, modify, display, delete, distribute, download, store, reproduce, transmit, publish, sell, resell, adapt, reverse engineer, or create derivative products from the Content; nor (ii) use the Content on other websites or any communication medium, such as a network environment, without prior written authorization from CC.

All trademarks, service marks, and logos (hereinafter, the “Trademarks”) displayed on the Website are the exclusive property of CC and their respective owners.

The User may not use the Trademarks in any way without prior written authorization from CC and the respective owners.

4. USER-PROVIDED INFORMATION

By providing or entering information on the Website (“User Information”), the User grants CC a permanent, non-exclusive, irrevocable, royalty-free license and right for the maximum time permitted by applicable law to use, copy, modify, display, distribute, download, store, reproduce, transmit, publish, sell, resell, adapt, and create derivative products, in whole or in part, from the User Information. The User acknowledges and agrees that CC is merely a passive forum through which users can make virtual cemetery visits and contract services offered by AISA. CC does not verify or control User Information and, consequently, does not guarantee its reliability, accuracy, completeness, validity, or truthfulness.

CC reserves the right, at its sole discretion, to remove, withdraw, refuse to display, or block any User Information that CC deems unacceptable. If CC receives notification regarding the unacceptability of specific user-provided information, CC may, at its sole discretion, investigate such information.

The User acknowledges and agrees that CC may retain a copy of the User Information and disclose such information to third parties.

5. GENERAL PROHIBITIONS

By accessing and using the Website, the User agrees NOT to:

Violate applicable local, state, provincial, or national laws (Argentina);
Infringe intellectual property and privacy rights, including but not limited to patent (copyright) rights, database rights, trademarks, or third-party know-how;
Download, send, transmit, or store material that:
- Is illegal, offensive, defamatory, fraudulent, misleading, deceptive, harmful, threatening, hostile, obscene, or objectionable;
- Violates the User’s contractual or confidentiality obligations;
- Harms or interferes with the Website’s normal functionality, such as transmitting viruses, worms, or trojans, sending repeated material, or sending unusually large files;
- Is not permitted by CC, such as unauthorized advertising, unsolicited promotional material, “junk mail,” “spam,” “chain letters,” pyramid schemes, franchise offers, or other unacceptable material;
Violate personal rights and privacy of third parties by misusing the Content, such as by harassing individuals or collecting personal data;
Attempt to circumvent the Website’s security measures;
Use automated tools (e.g., spiders, crawlers) to access or retrieve Content without prior written consent from CC;
Access or attempt to access third-party accounts or logins on the Website;
Impersonate another person or entity;
Use the Website for unauthorized or illegal activities;
Falsify email headers;
Misrepresent themselves, their associations, or their business.

6. USE OF THE WEBSITE AND SPECIFIC OBLIGATIONS

In addition to the general obligations under Section 5, the User must:

Use the Website solely for legally permitted purposes of visiting virtual cemeteries and/or contracting services through it;
Provide and maintain complete, accurate, up-to-date, and truthful personal data;
Only submit material for which they have the corresponding rights or licenses;
Use their own judgment, caution, and common sense when managing service contracts and using the information obtained through the Website;
Assume the risk of relying on third-party content or information.

7. LINKS TO THIRD-PARTY WEBSITES

The Website may contain links, such as hyperlinks, to third-party websites (“Related Sites”). Although CC reviews third-party material and allows inclusion of Related Sites that, to the best of its knowledge, do not violate applicable laws, CC cannot control or monitor Related Sites and, therefore, assumes no responsibility for their accuracy, security, reliability, content, or services.

The inclusion of Related Sites does not imply any relationship between CC and the owners of those sites, nor does it constitute an endorsement by CC. Users access Related Sites at their own risk and discretion.

CC reserves the right to remove Related Sites that infringe third-party rights or violate applicable laws.

8. PRIVACY

CC will process all personal information provided by Users through the Website in accordance with the Website’s Privacy Policy and the terms of this Agreement.

9. COOKIES

The Website uses cookies to enhance user experience. By using the Website, the User agrees to the use of cookies.

10. INDEMNIFICATION

The User agrees to indemnify, defend, and hold harmless CC and its affiliates from third-party claims arising from their access to or use of the Website, their User Information, or their violation of this Agreement.

11. DISCLAIMER

The Website is provided “as is” and “as available,” without warranties. CC disclaims any liability for errors, security breaches, or disruptions.

12. LIABILITY LIMITATION

Users assume all risks associated with using the Website. CC’s liability shall not exceed USD $10.00.

13. TERMINATION

CC may terminate Website services at any time, for any reason, without notice.

14. GENERAL PROVISIONS

This Agreement is governed by Argentine law. Any disputes shall be resolved in the courts of Buenos Aires (CABA).
